What is the FMCSA Clearinghouse?

The FMCSA Drug and Alcohol Clearinghouse is a federal database that tracks CDL drivers with drug and alcohol violations — all carriers must query it before hiring.

The FMCSA Drug and Alcohol Clearinghouse is a federal database that tracks CDL driver drug and alcohol program violations — all motor carriers must query it before any CDL driver operates a CMV and annually for all current drivers.

Launched January 6, 2020, the Clearinghouse contains records of positive test results, test refusals, and return-to-duty status. Owner-operators must register as both an employer and a driver. Hiring a driver with an unresolved Clearinghouse violation — or failing to query before their first drive — can result in penalties up to $16,000 per violation.

FMCSA / DOT Guidance

Per 49 CFR 382.701–382.727, employers must: (1) conduct a full Clearinghouse query (with driver consent) before any CDL driver's first drive; (2) conduct an annual limited query for all CDL drivers; (3) if a limited query returns a "record exists" result, immediately conduct a full query. Registration is free at clearinghouse.fmcsa.dot.gov.

Common Mistake

Owner-operators often register in the Clearinghouse as a driver but forget to also register as an employer. Both roles require separate registration steps. Failure to complete both means you can't query other drivers' records — and that omission is itself a violation.
